The Controller is responsible for the processing of personal data collected through the website www.actwo.ch.

2. Types of data collected

The website collects:

  • Browsing data (IP address, logs, technical access data).
  • Data voluntarily provided by the user through the contact form (first name, last name, e-mail, phone number, messages).
  • Cookies and tracking tools (see the Cookie Policy).

3. Purposes and legal basis of processing

Data are processed in order to:

  • reply to requests sent through the contact form;
  • provide information about the company’s services;
  • ensure the security and proper functioning of the website;
  • comply with legal and tax obligations.

Legal basis: consent (Art. 6(1)(a) GDPR), pre-contractual measures (Art. 6(1)(b) GDPR), compliance with legal obligations (Art. 6(1)(c) GDPR), legitimate interest (Art. 6(1)(f) GDPR). For users in Switzerland, processing is carried out in accordance with the Federal Act on Data Protection (FADP).

4. Processing methods

Processing is carried out using IT and electronic tools, lawfully, fairly and transparently, in compliance with European (GDPR) and Swiss (FADP) legislation.

5. Data retention

Data are kept only for as long as necessary for the stated purposes:

  • contact data: up to 24 months;
  • administrative/tax data: for the period required by law;
  • cookies: according to the duration stated in the Cookie Policy.

6. Disclosure and transfer of data

Data are not disseminated. They may, however, be disclosed to third parties that provide technical services to the Controller, such as hosting, website maintenance, e-mail, anti-spam protection and the delivery of content and external libraries. These parties may also be located outside Switzerland or the European Union; in that case the transfer takes place in compliance with the safeguards provided by applicable law, for example adequacy decisions (including the EU-U.S. Data Privacy Framework and the Swiss-U.S. Data Privacy Framework) or standard contractual clauses. In particular, data may be transferred to Member States of the European Union (in particular Ireland), to the United Kingdom and to the United States of America.

The third-party services used by the website are:

  • Google reCAPTCHA (Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland): service used to protect the website’s forms from spam and automated access. To work, it collects technical data about the device and browsing behaviour, including the IP address. Google Privacy Policy.
  • Google Maps (Google Ireland Ltd.): interactive map service used on the Contact page. The map is loaded only with the user’s prior consent; in that case Google receives the IP address and may set cookies. Google Privacy Policy.
  • YouTube (Google Ireland Ltd.): video-sharing platform used to embed videos on some pages of the website. Videos are loaded only with the user’s prior consent; in that case Google receives the IP address and may set cookies, including for profiling purposes. Google Privacy Policy.
  • jsDelivr (Volentio JSD Limited, a company registered in England and Wales, United Kingdom): content delivery network (CDN) used to load libraries and static resources required for the website to function. The service receives the visitor’s IP address. jsDelivr Privacy Policy.
  • unpkg (service based on Cloudflare, Inc. infrastructure): content delivery network used to load JavaScript libraries used by the website. The service receives the visitor’s IP address. Cloudflare Privacy Policy.

Data sent through the contact form are processed exclusively by the Controller and by the hosting and e-mail providers that ensure its operation.

7. User rights

The user has the right to:

  • access, rectification, erasure and restriction of processing;
  • data portability;
  • object to processing;
  • withdraw consent at any time, without affecting the lawfulness of processing based on consent given before its withdrawal;
  • lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) in Switzerland or with the supervisory authority of their country of residence in the European Union.

8. Security

The website uses secure protocols (HTTPS), anti-spam measures and protection tools to prevent unauthorised access.
